I googled that, and this is the answer I got from Google: But you should contact your Social Security office. Spousal disability support benefits—officially known as Social Security spousal benefits tied to an SSDI (Social Security Disability Insurance) record—are the same in every U.S. state.
How Spousal Disability Benefits Work Nationwide
• Federal Program: SSDI and its auxiliary spousal/dependent benefits are run by the federal Social Security Administration (SSA) using uniform federal rules and formulas across all 50 states.
• Benefit Amount: A qualified spouse can receive up to 50% of the disabled worker’s primary insurance amount (full retirement age benefit).
• No State-by-State Variations: Your state of residence does not change the base spousal benefit calculation or rules. Average payouts may slightly vary between states only because local demographic and past-earnings histories differ, not because state laws alter the formula.
Key Eligibility Rules for Spousal Benefits
• Marriage Duration: You generally must have been married to the disabled worker for at least one continuous year.
• Age or Child Care: The spouse must be at least 62 years old, or be any age while caring for a child of the worker who is under age 16 (or disabled before age 22).
• Own Work Record Limit: If the spouse qualifies for their own Social Security retirement or disability benefit that is higher than the spousal benefit, they will receive their own higher amount instead of a combined total.
